Please read these terms and conditions before using this website.
PRICES AND TARIFFS:
All prices on this website are quoted in US DOLLARS unless otherwise stated and are subject to change at any time. All offers are subject to availability. St Lucia Online Travel will not be held responsible for policies, terms and conditions, cancellation policies or other policies, warranties or guarantees of third parties. We therefore strongly suggest that you carefully check such third party documentation.
Please note: Services not mentioned on this website are not included in the quoted prices - e.g use of hotel telephones, mini-bars and other hotel services, or extra beverages consumed in restaurants or on tours.
DEPOSIT AND FINAL PAYMENT:
To make a booking online, full payment must be made at the time of booking. Your credit card will not be debited until final confirmation of the rates and availability is carried out by our Travel Consultants. The payment amount includes a non-refundable deposit of 10% of the total cost of the reservation.
CANCELLATION BY YOU:
If you cancel a booking within three (3) weeks of the check-in date, you will incur a cancellation fee as specified for the given property on this website, plus the 10% non-refundable deposit. In this event you waive any rights to compensation from St Lucia Online Travel, and accept full responsibility for any cancellation fee.
CANCELLATION BY US:
We always expect to be able to provide you with all the services we have confirmed to you at the time of your booking. However, we use the services of third party suppliers such as hotels over whom we have no direct control. Therefore occasional changes may have to be made due to circumstances beyond our control. Very rarely it is possible that we may be advised by a hotel or other supplier that the reserved accommodation / service is not available (due to urgent / unforeseen repair work). If this happens before or upon arrival at the hotel, we will endeavor to provide accommodation of at least the same standard in the same area. If only accommodation of a lower standard is available, we will refund the difference of the prices between the hotel booked and the available hotel.
AGE AND RESPONSIBILITY:
You represent that you are of sufficient legal age to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site. You understand that you are financially responsible for all use of this site by you and those using your login information.
PRIVACY:
You have read the St Lucia Online Privacy Policy, the terms of which are incorporated herein, and agree that the terms of such policy are reasonable. You consent to the use of your personal information by St Lucia Online and/or its third party providers and distributors in accordance with the terms of and for the purposes set forth in the St Lucia Online Privacy Policy.
LIMITATION OF LIABILITY:
a) The St Lucia Online Travel web site. St Lucia Online Travel assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in this site or your downloading of any materials, data, text, images, video or audio from the site. In no event shall St Lucia Online Travel or any third party providers or distributors be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with (i) any use of this site or content found herein, (ii) any failure or delay (including, but not limited to the use of or inability to use any component of this site for reservations or ticketing), or (iii) the performance or non performance by St Lucia Online Travel or any third party providers or distributors, even if such party has been advised of the possibility of damages to such parties or any other party. If, notwithstanding the foregoing, St Lucia Online Travel or any third party provider or distributor should be found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or uses of this site or its content, the liability of St Lucia Online Travel and the third party providers and distributors shall in no event exceed, in the aggregate, US$ 10.000. In its sole discretion, in addition to any other rights or remedies available to St Lucia Online Travel and without any liability whatsoever, either St Lucia Online Travel at any time and without notice may terminate or restrict your access to any component of this site.
b) Reservations: St Lucia Online Travel acts as an intermediary between you and the ultimate supplier of services and as such cannot be held responsible for any loss or damage arising from any action of third parties e.g. the Hotels. St Lucia Online Travel and/or their agents will not be held responsible for any damage, expense or inconvenience caused by the late arrivals or departures, change of schedule, strikes or any other conditions, nor will they be held responsible for any loss or damage to baggage or any of the clients belongings. However St Lucia Online shall use its best endeavors to ensure you have a pleasant stay in St Lucia.
c) Hotel Descriptions: The Hotel Descriptions in the St Lucia Online Travel web site are deemed to be correct and accurate at the time of writing and therefore St Lucia Online Travel cannot be held responsible for any changes in the Hotels services, furnishings or equipment which the guests may find on arrival at the accommodation.
INDEMNIFICATION: You shall indemnify St Lucia Online Travel and any third party providers and distributors and their officers, directors, employees and agents from and against any claim, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by or on your behalf in excess of the liability described herein or by third parties as a result of your use of this site.
GOVERNING LAW: This Agreement and its performance shall be governed by the laws of the state of St Lucia without regard to its conflict of laws provisions. You consent and submit to the exclusive jurisdiction of the state of St Lucia in all questions and controversies arising out of your use of this site and this Agreement.
ADDITIONAL TERMS: Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this site, and you agree to abide by such other terms and conditions.
SEVERABILITY: These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
HEADINGS: The heading used in these Terms and Conditions are included by convenience only and will not limit or otherwise affect these Terms and Conditions.
ENTIRE AGREEMENT: These terms and conditions, together with those incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this site.
